A judge in Chicago explained that the 53-year-old R&B singer is still a flight risk among several other reasons for the decision according to legal documents obtained by TMZ on Tuesday. 

The judge said: ‘[Kelly] is currently in custody because of the risks that he will flee or attempt to obstruct, threaten or intimidate prospective witnesses. The defendant has not explained how those risks have changed.’R. Kelly is awaiting trial on child pornography and other charges and recently expressed fear of contracting COVID-19 behind bars.

However, the judge explained that there are no confirmed cases of the virus at Metropolitan Correctional Center (MCC) in Chicago where the singer currently is.

The Trapped In The Closet singer had also argued that he part of the at-risk group to which the judge retorted that Kelly ‘is fifty-three years old, twelve years younger than the cohort of ‘older adults’ defined by the CDC as at high risk.’

As for Kelly’s argument that he has had surgery in jail, the judge continued to surgically tear down the singer’s arguments as he said: ‘He does not explain how his surgical history places him at a higher risk of severe illness. The singer had also argued that he can’t meet with his lawyers in order to strategize  for the trial in July to which the judge responded that they can communicate via phone and email. 

The Judge also said that it is unlikely that his trial will proceed as scheduled explaining ‘as conditions return to normal, [Kelly] and his lawyers will have additional time to prepare for trial.’

This came weeks after Kelly had cited the novel coronavirus in asking a federal judge to free him from a federal jail in Chicago as a court filing by his lawyers saying scant precautions to stem the spread of the virus behind bars put Kelly’s life at risk.

Sanitizer and even soap is hard to come by in the MCC, with most of its 700 inmates held in small, two-man cells that make the kind of social distancing called for to thwart the transmission of COVID-19 impossible, the filing in U.S. District Court in Chicago says.

Kelly, 53, faces several dozen counts of state and federal sexual misconduct charges in Illinois, Minnesota and New York, from sexual assault to heading a racketeering scheme aimed at supplying him with girls.
